Insurance companies are making it tougher and tougher to collect medical costs incurred due to minor car crashes. According to a recent 18-month investigation conducted by CNN, you could be in the fight of your life if you’re trying to get an auto insurance company to pay medical costs you incur due to an auto accident, even though the accident was not your fault.

The article states that this type of “insurance hardball” particularly happens in relatively minor accidents such as fender benders where there is no injury that may be seen by the naked eye or established with an X-ray.

This insurance-company’s- “play-tough” trend is apparently a recent one, a strategy adopted and religiously enforced by the nation’s two largest insurance companies, State farm and Allstate. According to the CNN investigation, the result of such a strategy has been extremely profitable for the insurance companies, but has hurt consumers significantly. People end up getting dragged through the court system over fender bender claims, but no one sees any benefit such as reduced premiums. In fact, the dirty little secret of the insurance industry for the last 15 years has been this – they’re paying out much less for minor auto accidents, their profits are soaring as are your premiums. Of course, for them, it’s a winning formula.

CNN’s investigative team reportedly reviewed more than 6,000 company documents and court records and conducted interviews with numerous people including former insurance company insiders, accident victims and other experts. This is what they learned. If you challenge an insurer after a car accident and refuse to accept what the insurance company offers you, even if you are insulted by it – you will be left with little option but to go to court and be dragged through a complex, expensive and slow system.

Why is it that fighting an insurance company is not beneficial to a consumer? Because it takes up so much time and so much money. You can’t really turn to a personal injury lawyer because the experienced ones refuse to take on these cases. They know that the payoff for their client and the law firm is to low to make it worth taking up the cause. The law firm makes no money and the client is dissatisfied with the recovery the law firm got for them. It is a now win situation for the lawyers. It is simply not worth it for them to be involved.

Insurance company employees at Allstate were reportedly instructed to get rid of claims quickly by offering a pittance to accident victims – in some cases, amounts as low as $50. The injured person could take it or leave it or sue. And then the insurance companies complain about the volume of lawsuits.

CNN talked to two victims who experience this first-hand. Roxanne Martinez of Santa Fe suffered neck and back injuries when she was sideswiped by a driver insured by Allstate. After three years of back-and-forth, the company offered her $15,000, barely half of what she needed to cover lost income and pay medical bills. She took it to court and four years after the accident, a jury awarded her $167,000 plus interest.

But an Indiana woman, Ann Taylor, was not so lucky. Taylor suffered a herniated disc and muscle tears after she was rear-ended by a State Farm insured. Her bills and lost wages totaled nearly $15,000. But how much did State Farm offer her? $2,000. She was insulted and she sued, but the jury returned with an award of only $1,500 because the insurance company’s attorney showed them an enlarged picture of Taylor’s car after the accident, in which the vehicle had a small dent. So jurors said they thought Taylor was only trying to get more money out of the insurance company.

Experts say this strategy was devised to boost profit for the insurance companies in the mid-1990s with the help of a consultant. Those documents obtained by CNN recommend that insurance companies put on their boxing gloves when it comes to soft-tissue injuries in minor crashes. Their strategy outlines three D’s – denying a claim, delaying settlement of a claim and defending against the claim in court. Other experts say that this strategy helped insurance companies weed out so-called victim’s attorneys “who make a living off auto accident victims.” They argue that lawyers are upset about insurance companies playing hardball with the public because they fear that “the gravy train is over.” The insurance companies did not mention how their tactics were unfair to the innocent auto accident victim; they just blamed everything on the personal injury attorneys.

The party that really suffers in a minor injury crash is the average driver, the guy who is not ready financially to spend thousands at a given time to handle medical expenses for issues such as chiropractic work, which is not covered under many health plans or to be off work for a week or more. It is the average consumer who suffers as a result of this profit-mongering strategy adopted by insurance companies. It is these companies that stand to profit millions by not paying what is due to innocent, injured auto accident victims and then worsening the situation by increasing premiums.

The truth is that a minor car accident can cause a significant injury. This is especially so to seniors and people with preexisting conditions… We’ve had clients who suffered severe back injuries in a moderate rear-end accidents. Yes, many of them were elderly but aren’t they entitled to safe passage on our highways? Aren’t they entitled to compensation for the damage done, regardless of their age? Yes, many of the others are people with preexisting conditions, especially “degenerative disc disease”, a medical term for the wearing out of your spin through age.

We have seen people in the forties who are as fit as can be get into a small or moderate rear end collision and have serous neck and back issues. The insurance company claims it is a preexisting condition, “degenerative disc disease” and they refuse to pay. In these cases it is true that the “degenerative disc disease” was present before the accident. What wasn’t there before the accident was the pain and discomfort. The “degenerative disc disease” was asymptomatic; meaning it wasn’t hurting or causing any problems. The accident caused the degenerative disc disease – to become symptomatic, in other words, painful and in some cases debilitating.

Just because you are over 40 years-old does not make you fair game for a spinal injury or for an insurance company rip-off.

There are some steps you could take to make sure you are protected or covered if you get involved in an auto accident – major or minor. The first step, if you are able to do so after an accident, is to get insurance information, name and address of the parties involved in the crash and any witnesses. Also, take as many pictures as possible of the site even if it’s on your cell phone. Finally, get a thorough check-up. Remember that symptoms could surface after several days up to a year or more.

We have recommended to a significant number of people to just take the negligent driver to small claims court. Bypass the insurance company altogether. Bring the traffic collision report and your medical records to court along with any witnesses you have to your accident and the difficulties you have suffered since and let a judge decide. The negligent driver’s insurance company will pay the judgment and neither of the parties can be represented by an attorney.

Small claims court is quick and easy. It is much quicker than haggling with an insurance adjuster for months. Can State Farm Insurance force us to take our car back to a bodyshop that has messed it up twice already?
Our car was repaired by an inept bodyshop twice and both times it was in their possession the car was broken into, ie; the tops of both front doors were pulled out at the top. The A/C isn't working now, because of the bodyshop's shotty workmanship, and the State Farm Insurance is telling us we HAVE to take it back to the bodyshop that has already messed our car up twice. After the first fiasco, we were told that the bodyshop was allowed to try to fix their poor work and we gave them that chance but other things got messed up that had nothing to do with the required repairs. It was as if they were trying to damage our car intentionally.

Can State Farm Insurance force us to take our car back to an inept bodyshop for the third time?

For years State Farm Florida Insurance Company has remained one of the few Fortune 500 homeowners insurance companies still doing business in Florida. It is still by far the largest private insurance company in the state for both homes and autos covering 1 million and 2.5 million policyholders respectively.

They deserve credit for that.

After all, following the billions in claims from Hurricane Andrew in 1992, many large insurance companies simply left the State of Florida for good – and never looked back. That left Florida to deal with the problem on its own and caused it to create its own state run insurance company of last resort to help those who simply could not find coverage.

State Farm Florida Insurance Company did not follow this approach.

It has taken a prudent approach to the market that has been present in Florida since Hurricane Andrew. These steps have included:

Strict underwriting criteria for homes selected for new business

Multiline discounts for policyholders with home, auto, and life coverage

Selectively cancelling higher risk older homes closer to the coastline

This approach might have been successful during normal, reasonable periods of history. But things in Florida have been anything but reasonable in recent years:

From 1992 to 2004, no large insurance companies re-entered the Florida home insurance market – leaving State Farm on its own.

Florida hurricane claims in 2004 and 2005 caused billions of dollars in damage. State Farm Florida paid millions in claims and had to request an emergency cash infusion from its parent company to recapitalize it.

While the company was able to get significant rate increases after the 04/05 hurricanes, massive rate increases granted to most of the companies in Florida in 2005 and 2006 caused a major political uproar. Quite honestly, the public demanded rate relief because Florida home insurance was simply not affordable.

The pressure for lower rates was far worse due to outrageous property taxes and the collapse of the Florida real estate market.

The State of Florida reacted to voter pressure. But the results were not impressive.

The 2007 and 2008 legislation had a minimal effect on lowering homeowners insurance rates and shifted billions of dollars in catastrophic risk to the Florida Hurricane Catastrophe Fund – a state entity that has publicly stated that it can’t meet its reinsurance obligation to insurance companies in part due to the frozen bond markets.

As a result, all companies including State Farm Florida are concerned that the Florida Cat Fund won’t be there to pay them back after a major hurricane and are looking for new sources of backup reinsurance.

That, combined with other factors led the company to request a 47% rate increase a few months ago. After state regulators rejected the rate increase, the company appealed that decision in court. Recently a judge agreed with state regulators that State Farm’s 47% rate increase was not justified and also rejected the rate increase.

This brings us to where we are today – a time when many Floridians have to be wondering if State Farm Florida is preparing to exit the state for good. This would not be welcome news and would cause a major shock to the Florida homeowners insurance market as policyholders scramble to find other coverage.

In today’s uncertain times, you have to be ready to face realities. One of those might be that State Farm will cancel or drop your homeowners insurance coverage in Florida. If that happens there are several things you need to do to respond to this:

Shop your policy. Most State Farm Florida agents can only offer you homeowners coverage with Citizens after your policy is cancelled. Find a large independent agent who represents multiple companies in order to give you the best options for replacing State Farm Florida.

There are new Florida base regional insurance companies that have been created over the past 15 years, with many only being recently approved since the start of 2006. Some of these companies might be a good option to replace State Farm but you have to research each and every one of them. Check their financial ratings and customer service history thoroughly.

State Farm Florida insurance agents will be hurt by mass cancellations of home insurance policies. They have spent years building a book of insurance business in Florida. When they lose your home insurance business, they often lose your auto and life insurance business as well. While you can’t help but be sympathetic, you need to know that it is in your agent’s self interest to keep your auto and life insurance business while putting your home insurance coverage into Citizens Property Insurance. Don’t accept being placed with Citizens without looking for other private home insurance companies through other agents that can also offer you auto and life insurance.

Get all the facts if you are thinking about Citizens Property insurance. Citizens has said that it does not charge enough premium to cover the risk that it takes. It too is expecting problems borrowing to pay its claims after a major hurricane in today’s troubled bond markets. Major recommendations being presently considered at Citizens include raising rates, limiting coverage, and mandating certain home hardening measures. Do your home work on Citizens just like you would for any other company.

While we don’t know how the final situation with State Farm Florida will play out, if you follow these steps you’ll be way ahead of hundreds of thousands of policyholders that might be scrambling to get coverage all at once.

Will my State Farm insurance cover my hitting a deer with a rental car in Michigan?
I was two miles from the Canadian border in Port Huron when i hit a deer. It bent the condenser and such. I did not purchase add-on insurance from Avis with the rental car. Would State Farm cover the damages from my hitting the deer?

When you’re sitting at home worrying about the mounting pile of bills to pay, it’s easy to lose sight of the big picture. Fact is, just as you’re in a new world of hurt, there are other people hurting as well. In this case, the people are the inventors in the insurance industry. They all bought shares in these big corporations when the prices were high, never thinking that the world could suddenly turn sour. Although it’s a mutual insurance company, let’s take State Farm as an example of what’s happening across the industry. This is one of the biggest insurance companies in the US and it’s just turned in an operating loss of $542 million for 2008. Its net worth just dropped a whole 16%. Now, you have to understand this company did not get caught up in mortgages of any prime. There were no securitised thises or derivative thats. This company has just been caught in the general collapse of stock exchange values. To understand, we need to look at how insurance companies work. They charge most policy holders with a vehicle or a home a monthly premium. This brings in a small mountain of cash every month. That money is invested until it’s needed to pay out on claims. Some goes into fixed-income products. The rest goes into shares. As you may have noticed, the Dow and other stock exchange indexes have been in free-fall. The result is that State Farm has lost the capital value of the investments and, in many cases, no longer receives any income as interest or dividends. This might have been manageable except for this little thing called global warming that no-one believes causes hurricanes and other weather catastrophes. The last two years have seen an big increase in weather-damage claims. Put the loss of investment income and the unexpected rise in claims together and you turn a $5.46 billion profit in 2007 into a loss in 2008. Should this make you worry? Well, look at it this way. The insurance industry is suddenly making a loss. Shareholders in general and the policy holders in State Farm are not happy. Senior officers of the companies want their bonuses. The for-profit companies are tempted to raise the premiums across the board to get their earnings back into profit. Except with a recession threatening to turn into a depression, that’s not going to work. Make the policies unaffordable and people stop buying. That’s why State Farms just dropped its auto insurance rates in Georgia by an average of 1.5%. For the record, this means the current premiums are 12% lower than five years ago. Since State Farms insures around one quarter of all vehicles on Georgia’s roads, this is a good deal. So the next time you’re shopping round for a cheap car insurance policy, you may be pleasantly surprised that the premium rates from an increasing number of insurers have fallen in other states. The next bill may not be quite as painful as you fear.

Imagine that the company you work for started getting 17 calls per minute from customers with problems, and that the phone rang off the hook 24 hours a day, every day. You’d think something had gone terribly wrong.

For State Farm, that’s a typical day, as policyholders call to report claims at the rate of over 17 a minute. The nation’s largest auto insurer handles about 9 million claims a year, from stolen cars to fender-benders to total losses.

What’s an insurer to do with all those claims? State Farm makes good use of them. For one, the claims data help State Farm set the car insurance premiums for other drivers of those vehicles. For example, do you have a vehicle that’s a favorite of thieves? That’s reflected in your insurance bill. But State Farm also uses its wealth of claims data to encourage better and safer car design.

Remember when Ford Explorers with Firestone tires gained national attention in 2000 because of alarming numbers of rollovers? State Farm was the first to sound the alarm bell to the National Highway Traffic Safety Administration in 1998.

State Farm regularly communicates with auto makers on what it sees as potential vehicle improvements based on trends in customer claims. When the insurer sees a way a car could be better protected from theft, or a bumper that never survives a crash, or a car with high passenger injuries, it lets car manufacturers know.

“You try to work together and find a common ground,” explains State Farm spokesperson Kip Diggs. “Even if they don’t acknowledge that the idea came from you. It’s a satisfying gig.” And it’s a gig that stands to benefit all car buyers, not just State Farm customers, through safer vehicles and, ultimately, lower car insurance rates.

State Farm doesn’t charge auto makers for its recommendations, and doesn’t even expect a thanks. But for four men in State Farm’s Vehicle Research Facility in Bloomington, Ill., it’s their lives’ work.

State Farm not only examines past claims for problematic vehicles, but it also pulls those vehicles into its reseach facility and tears them down, looking for clues as to why those vehicles incur extra costs. They tear down 25 to 50 vehicles a year, most of them wrecked or damaged. For example, State Farm employees noticed a couple of years ago that the Chevrolet Cobalt, which shared a platform with the Saturn Ion, performed much better than the Ion in side-impact crashes. State Farm brought the two vehicles into its facility, took them apart, and discovered that Chevrolet had added side reinforcements in the Cobalt, increasing passenger safety.

Figuring out how to keep vehicles safer from theft is also significant work at the State Farm facility.
“If a professional wants your car, he’s going to get it,” says Diggs. “But if we can find ways to make a car frustrating to get into for a professional, and less atractive to thieves and joyriders, that’s worthwhile.”
Suggesting ways for auto makers to produce cars with lower repair costs is also a mission. When your damaged car goes into the body shop for repairs, “everything goes by time,” says Diggs. “Labor’s where the money is. A vehicle that can be repaired more quickly is a vehicle that’s going to be less expensive to insure. Even if you’re an Allstate or Nationwide customer, you get the benefit of that vehicle.”

“State Farm has an interest in seeing cars built to better standards,” says Diggs. “Some manufacturers listen, some don’t.”

Case in point: The Mustang

When Ford was designing its current-generation Mustang in the late ’90s, it asked State Farm to look at the design and give an opinion. Earlier Mustangs didn’t sport a great safety record and were high on theft lists. State Farm employees tore down the Mustang and made recommendations to Ford (free of charge).

Shortly after the new 2005 Mustang GT came out, State Farm got its hand on the first one that had been titled and wrecked,. (It had been purchased for a 16-year-old in Chicago.) State Farm employees wondered if any of their suggestions had made it into the design.

“We were pleased to see some suggestions made it in,” says Diggs, such as the way Ford had affixed panels and hard pieces to the car that makes it easier for the vehicle to be repaired.

A relative has just died. He had a life insurance policy with you listed as the beneficiary. There’s just one problem: the life insurance policy is missing. You have no idea which insurance company wrote it.

If you find the missing life insurance policy in the future, are you still eligible to receive the death benefit?

Hope they paid their insurance bills

If you’re a beneficiary and you find the lost life insurance policy shortly after the insured dies (within six months to a year, for example), claiming the death benefit should be trouble-free.

First, determine if the insured had term or permanent life insurance. If the insured held a term policy, you’ll receive the death benefit if he died before the end of the policy term. If he died after the policy expiration date, you would get nothing.

If the insured had a permanent life policy, you’ll receive the money if the death occurred while the policy was “in force,” meaning all premium payments were made up until the time of death. If the death was a while ago, you’ll receive the benefit with interest from the date of death.

If the life insurance policy lapsed — meaning the insured stopped making premium payments before he died — there’s a chance you might get nothing. When a permanent life insurance policy lapses, most insurance companies switch its status from permanent insurance to one of two options:

“Extended term” — The insurance company uses the cash value of the policy to buy a term life insurance policy for the same death benefit using the cash value of the policy. The death benefit will continue for the longest period the cash value will purchase.

“Reduced paid up” — The insurance company will keep the policy in force permanently, but will reduce the death benefit.

Gerry Brogla, an actuary for State Farm, says in the majority of the cases at his company, the permanent policy continues as extended term if it lapses. At State Farm, extended term is the default option for most permanent policies.

If the policy lapses, and the extended-term period expires before the insured dies, the policy is worthless and the life insurance beneficiary will get nothing. If the insured dies before the extended-term period is up, the beneficiary will receive the death benefit. If the policy lapsed because the insured died (thus ending premium payments and causing the insurance to be placed in extended-term status), the beneficiary will still collect the full death benefit, regardless of when the extended term was up. The beneficiary always needs to supply the insurance company with a death certificate to verify the date of death.

There is no time limit during which a life insurance beneficiary must step forward to collect the money, according to Jack Dolan, spokesman for the American Council of Life Insurers. “If a person shows up 30 years after [the insured's] death, the company still makes good on it,” Dolan assures.

What happens if no one ever reports the death?

If the insured dies and the insurance company does not learn of the death, the policy lapses. Insurance companies will take steps to find out why a policyholder stopped making payments.

When an insurance company stops getting payments, it sends letters to the insured informing him the policy may lapse as a result of unpaid premiums. If the letters go unanswered, the company might initiate a search to find the insured. If that comes up empty, the company will then lapse the policy.

If a beneficiary to a policy never steps forward, it unfortunately means the insured paid money to a policy throughout his life and his beneficiaries never see a penny. This is why its a good idea to make sure beneficiaries are aware of any life insurance policies you have.

If you’re lucky, the state may have your money

In some cases when a beneficiary fails to claim a death benefit for several years, the money is transferred to the state where the insurance policy was purchased under the escheat laws.

If a company knows an insured died and it cannot find the beneficiary, it must turn the full death benefit over to the state comptroller’s department within three to five years of the insured’s death. The money is transferred to the state where the insured bought the policy. The money is considered “unclaimed property” and gets lumped in with dormant bank accounts and uncollected rent deposits. The comptroller’s department maintains a database that lists the names and addresses of lost life insurance beneficiaries.

Many states will try to contact life insurance beneficiaries in an effort to pay the death benefits. In Texas, for example, the names and addresses of the beneficiaries are published annually in each county in the state. In New York, the Web site of the New York State Comptroller’s Office of Unclaimed Funds has an online search to find any unclaimed death benefits owed to you. You can find out the procedures in your state by contacting the office of your state comptroller or treasurer.

Keep in mind your chances of finding the policy with the state are slim. The insurance company has no obligation to hand the money over to the state if it’s unaware the insured died. In most cases, it’s the beneficiary who contacts the insurance company.

Also, the insurer only transfers the money to the state three to five years after it cannot find the beneficiary but knows the insured died. If the state doesn’t have the death benefit, it’s likely the insurer is still looking for the beneficiary or doesn’t know the policyholder has died.

Unclaimed death benefits are rarely transferred to the state. Dave Potter, a spokesman for Hartford Life, says less than 1 percent of his company’s death benefits go unclaimed.

Del Chance, a life insurance claims manager at State Farm, says, “Turning over life policy benefits to an individual state after the death of an insured is extremely rare. State Farm utilizes their own search techniques as well as outside vendors to locate lost beneficiaries in the event of the death of one of our insureds. By and large these procedures have always located the beneficiary.

Tips for making sure your life insurance beneficiaries get your death benefit:

1. Give your beneficiaries your policy information. It can be a difficult and awkward conversation, but an important one.

2. Keep all your financial records (especially your life insurance policies) in one place. Don’t force your beneficiaries to search your house from top to bottom after you die.

Tips for looking for lost life insurance policies:

1. Go through canceled checks or contact your relative’s bank for copies of old checks. Look for checks made out to insurance companies.

2. Ask those who may have known about your relative’s finances. Speak with the relative’s lawyer, banker or accountant. Also contact the relative’s insurance agent.

3. Contact your relative’s past employers. They might know of possible group life insurance. The insured might have also purchased supplemental life insurance through work.

4. Check the mail for a year. Premium bills and policy-status notices are usually sent annually.

5. Look at income tax returns for the past two years. Check for interest income from policies or expenses paid to life insurance companies.

6. Contact the Medical Information Bureau. If your relative bought life insurance fairly recently, there might be a trail of the companies to which he applied. The Medical Information Bureau (MIB) maintains a database that might show if insurers requested your relative’s medical information within the past seven years. Record searches can be requested through the MIB’s Policy Locator Service and cost $75. The MIB says that nearly 30 percent of searches turn up leads.

How many of you have been hit by a driver with State Farm Insurance and the d***** company refuses to pay?
I'd just like to see how many YES answers I get… you can tell the whole story if you want to. My son was t-boned by an old lady turning left – he was going straight – and that was almost 4 months ago, and he still hasn't gotten them to pay a liability claim. Everybody we talk to – insurance agents – the car storage company – all say that State Farm ALWAYS does this. Now I know that they must pay SOME claims… so I don't really want to hear about those. I just want to see how many people DON'T get their claims paid by State Farm.
No her policy did not lapse. My son's insurance adjuster said that State Farm's agent wants to try to put some of the blame on my son. His company, Progressive, thinks it is ridiculous that a car going straight would in any way be at fault when somebody turns left into them and there is no damage to their front end at all. Progressive also said that State Farm does this crap all the time.
My son's insurance company has no concern for this incident because he carries liability only, and of course they aren't going to pay because he was not at fault. He was also pushed by this old lady into a 3rd vehicle who was stopped at the light, waiting to go straight. The 3rd driver is, I believe, also still waiting for State Farm to pay those damages incurred by their insured making a left turn.
I know another person who had a car accident a few years ago, it was obviously their fault, and they had State Farm. Their company refused to pay, and they finally got sued by the other driver, to make their company pay. They no longer carry State Farm. So… your company is NOT doing you any favors when they refuse to pay for accidents that were YOUR FAULT.
