    Reality check.

The philippines has good sound laws but corrupt political influences always delay the implementation of these laws.

By the time these laws are enforced, they become so obsolete that another law must be passed (just like the politicians who regularly pass gas – i.e. fart through their mouth).

    Hiya:

Sorry you were hurt. :-( But – hopefully this will help you out.

THIS is what happens in a Bodily Injury claim:

#1 – YOU need to do what you need to do to get better. Hopefully you weren't seriously injured. Take care of yourself, ok?

#2 – The person who was responsible for your injuries will be responsible for the bills. Thankfully they had insurance.

#3 – Although they will be responsible for the bills – they do NOT have to pay them as you incur them. They will take the bills (the related reasonable, customary and usual expenses for your related diagnosis) into consideration for your settlement – but again – they don't have to pay them until you settle.

You can do 1 of 3 things are far as bills are concerned in the meantime. > Have them paid under YOUR insurance MED PAY coverage (provided you pay for this coverage under your own policy) If you do – it is something you pay for and are entitled to no matter who is at fault. There is usally a dollar limit of coverage but it will get the bills and bill collectors off of your back until you settle. If you DO use this coverage – your insurance company will have a lien against your settlement. That means that they will collect their output from your settlement before you get your money. OR – You may allow the providers to assign a lien against your settlement. This will get them off of your back about payment once they know they are guaranteed payment. OR – you could have your health carrier pay the bills (in which case you would have to pay your co-pays but you SHOULD request your out of pocket expenses back as part of your settlement)

#4 – At some point – you are going to HAVE to sign a medical authorization. Personally – the sooner you do this the better. It allows the insurance company to actively obtain your medical bills and notes as you incur them. When it is time to settle – if they have everything already – you'll get your settlement done quicker. You can try to get copies of everything as you treat and provide them to the insurance company, too.

#5 – Stay informed. Stay in contact and get better. It sucks to be injured.

    Hope all goes well. Goodluck.

    1) Whether or not the hospital sends you a bill, you'll want to be sure that you obtain an itemized copy of it for your records. Your adjuster has likely asked you to sign a medical authorization form. If you've elected not to hire an attorney, my recommendation is that you provide him with a signed medical authorization. This doesn't waive any of your rights and will allow the adjuster to gather all of your bills and records at no cost to you.
    2) No. The 3rd party's insurance company will only pay for what is deemed as reasonable and necessary. I don't know anything about the severity of your accident or the extent of your injuries, so I can't comment on what might or might not be regarded as reasonable and necessary. Additionally, there are limits to liability. If your medical treatment exceeds the liability policy limits, you'll be on the hook for the overage. Depending on your state, you may also only receive consideration for medical expenses you actually incurred. For example – say you went to the ER and the hospital billed your healthcare insurance $1000. Your healthcare insurance company asserts its contractual agreement with the hospital and receives an $800 discount and only pays the hospital $200. If your state allows it, you may only recieve consideration for the $200.
    3) Yes. Save your receipts.
    4) When you settle your claim, the insurance company will likely have completed a check for liens. If the hospital has filed a lien with the county, the insurance company will have to honor it and will want to issue a separate check to the hospital. Likewise if your healthcare insurance provider has put them on notice of a lien or if you are covered under Medicare/caid.
    5) See #4 above.
